The City of Folsom’s recycling programs are designed to meet state recycling laws and requirements. Below, you will find an overview of each law and the actions our city is taking to meet the requirements.

California's Short-Lived Climate Pollutant Reduction Strategy (SB 1383)

SB 1383, the Short-Lived Climate Pollutant law, addresses greenhouse gas emissions. SB 1383 expands organic recycling requirements to all residents, including single-family homes and apartment communities. SB 1383 sets a statewide goal of recycling 75% of the organic waste disposed of in landfills by 2025.
SB 1383 requires the city to provide a program to collect and recycle food and green waste from all residents and businesses. SB 1383 includes provisions for penalties and fines for those who do not comply.
To comply with SB 1383, Folsom began providing collection services for all organic waste, which includes all landscape material (yard trimmings, grass clippings, leave, untreated woods), food scraps (fruit and vegetable trimmings, meat and bones, bread and pasta, eggshells, coffee grounds, uneaten leftovers, and expired food), and food soiled paper (napkins, paper towels, greasy pizza boxes).
SB 1383 also requires the city to purchase products made from recycled organic material, such as compost, mulch, and renewable energy.
SB 1383 requires that paper and paper products purchased by the city are made from recycled fiber.
One of the goals of SB 1383 is to recover 20% of edible food currently disposed of in landfills statewide. This will involve coordination between certain edible food generators, including supermarkets, food distributors, restaurants, and cafeterias with food recovery organizations, including food banks and food pantries.
SB 1383 requires the city to enforce its provisions on residents and businesses and meet the 75% organic waste diversion goal. The city adopted an ordinance to accomplish this in 2021.
The Waste and Recycling Division evaluated the cost of mandated program modifications and customer rates were increased to provide the required services. SB 1383 is an unfunded state mandate, and as a result, a rate increase was unavoidable. A rate study was circulated in December 2021, and the mailer sent to all residents is available to view here.

California's Business and Multifamily Organic Waste Recycling Law (AB 1826)

California's Business and Multifamily Organic Recycling Law was adopted to reduce the amount of organic waste that enters our landfills, reduce greenhouse gas emissions, and help meet the statewide goal of 75% landfill diversion.
The law requires certain businesses, government agencies, and multifamily communities to divert organic waste from landfills through a specific program or service.
Organic waste includes food waste, green waste, landscape and pruning waste, non-hazardous wood waste, and food-soiled paper waste mixed in with food waste.
AB 1826 was phased in over the past few years based on the amount of waste produced from each location.

Additional State Recycling Laws

AB 939 the Integrated Waste Management Act was passed in 1989 and was the first diversion requirement in California. This law requires that every jurisdiction in California divert from landfill disposal at least 50% of the waste stream by source reduction, recycling, and composting. The city consistently meets or exceeds the state's 50% landfill diversion requirements in AB 939.
SB 341, the Mandatory Commercial Recycling law enacted in 2012, includes a statewide goal of 75% recycling by the year 2020. It requires that the city provide a recycling program and that certain businesses subscribe to its use.
SB 827 requires that certain businesses provide containers for recyclable materials sold and consumed on the premises and provide signage to identify those containers and what goes in them.
